Test case - Failed Direct Debit charges - Update

Background

The Office of Fair Trading (OFT), several major UK banks and one major Building Society started a test case in July 2007 to decide on the legality of unauthorised overdraft charges, including charges incurred where customers do not have sufficient money in their accounts to meet direct debits and standing orders.

Judgment in the case

On 28 November 2009 the Supreme Court delivered its final Judgment and ruled that these charges are not subject to a test of fairness on the grounds of cost.

Claims already made

If you have already made a claim seeking repayment of charges to the Society, you need do nothing further. We will be processing your complaint in accordance with FSA rules and will write to you in due course.
